I am often asked by potential clients, “Do I need a lawyer? Won’t the insurance take care of this?” After 10 years practicing in personal injury, witnessing the general insurance practice of systematically denying and diminishing the value of human suffering, I emphatically explain to these potential clients that the insurance will NOT take care of them in the manner they expect or hope.

I have two examples that highlight this unfortunate practice. The first example stems from a rear-end auto collision. We represent a single mother who was violently rear-ended, sustaining significant, ongoing concussion complaints, as well as neck and back injuries. We demanded settlement from the defendant’s insurance, and no surprise, the insurance company made an unreasonable settlement offer, disputing our client’s injuries. We filed a lawsuit and had the defendant served. The defendant was enraged, stating over and over, “my insurance company was supposed to take care of this.” He fell victim to the unfortunate state of the business of insurance.

The second example is arguably even worse. We represent the passenger of a vehicle who sought to use his own insurance policy of underinsured motorist coverage for serious shoulder injuries, requiring surgery, stemming from the car crash. His insurance denied his claim, and refused to make any payment for his bodily injuries. In that case, we had to seek a court order to compel his insurance company to participate in underinsured motorist arbitration, where we could hash out the case. We prevailed on the motion, and the court did order the insurance company to arbitrate the case. One might think this would be the end of the story… but it gets even worse. The insurance company has flouted the court’s order, and has taken no steps to arbitrate the case as ordered. We will be seeking a court order with sanctions for their refusal to follow the court’s order.

I have seen situations like this many, many times over the years. As such, my message to anyone with a personal injury claim: do not for one second be fooled into thinking that an insurance company, even your own insurance company, is going to “take care of it.” Insurance is a business, and insurance is in the business of making money, not taking care of people – and that includes YOU.
