Hit and Run… By Your Own Insurance Company?


We recently obtained a $100,000 policy limit settlement for a client who was involved in a hit-and-run car crash. Why do I choose to write about this settlement? I choose to write about this settlement because it highlights the systemically corrupt controversy that exists between an individual and an insurance company, even one’s own insurer.

It is a warm, summer night in Anaheim. My client is mere blocks away from his home. He pulls up to a red light, and comes to a stop as any attentive, responsible driver would. The car behind my client, however, does not stop. He slams right into the back of my client’s SUV. My client – somewhat shocked by what just happened – removed his seatbelt, and begins to open his door. At the same time, the other driver speeds away from the scene. By the time my client is able reach for his phone, the other driver is too far, and it is too dark, to capture any identifying information.

My client promptly files a police report, and thereafter opens a claim with his insurance company. A few weeks pass, and no one is able to locate any information for the hit-and-run driver. In those few weeks, my client notices worsening neck pain and headaches. The pain rears its ugly head everyday, and he cannot tolerate it anymore. My client wants to open an injury claim with his insurance so he can get medical treatment.  He calls his carrier. The insurance adjuster tells my client that he did not have “medical coverage,” and shuts down his hope of obtaining medical treatment. Whether by dubious motivations, or just plain incompetence, this statement was untrue. Talk about being “kicked when you’re down!”

I wish I could say this call was the first of its kind, but it’s not. I have lost count of how many times in the past nine years clients have called me confused, frustrated, and just plain beaten down by their unsuccessful efforts to simply negotiate what is fair – in fact, what they bargained for all those years ago when they first purchased their insurance policy! In fairness, I surely see the worst of it. But, tread carefully, and do not expect a fair fight!
